Preamble Fair Trading, Responsible Travel and Plain Language

We operate a fair trade policy based on dialogue, transparency, and respect, which seeks greater equity in international and national trade with consumers and suppliers. We are engaged actively in awareness raising, and in campaigning for changes in the rules and practice of conventional international and national trade.

We have a firm commitment to the principles of responsible travel, especially minimising the environmental and social impact of travel, and strive to ensure that a visit from a traveller has a positive effect on Cuba. We are supporters of an ethical, caring world in the future success of the travel industry.

We have attempted as much as possible to avoid too much legal jargon in these Terms and Conditions and using plain language that is easily understood. Our website also follows this principle as do our communications with you.

Please read these Terms and Conditions before using this Site or before contacting Cuba Travel. You consent to these Terms and Conditions when you use this Site, without qualification. If you disagree with any part of the Terms and Conditions, you may not use this Site in any way.

This Site is operated by CUBA TRAVEL, a subsidiary of Caribbean Select Travel Ltd, officially authorized and licensed by the Cuban Ministry of Tourism and Chamber of Commerce to provide hotel and transportation products and services in Cuba.

These Terms and Conditions also apply to any reservations which are not made by you on this Site but where you communicate directly with Cuba Travel or making Arrangments by way of emails, mail (postal service), telephone, fax, Customer Online Chat Service or personal presentation to the office or to the staff of Cuba Travel.

Terminology Used in this Contract
This website is referred to as the "Site". The final recipient(s) of the services in Cuba are hereafter referred to as ‘’you’’ or ‘’your’’. The products and services provided in Cuba are hereafter referred to as the ‘’Arrangements’’. The end supplier of the Arrangements in Cuba is hereafter referred to as ‘’Supplier’’.

Our Service Provision
Cuba Travel and our affiliates act as agents for Arrangements supplied by third party Suppliers, such as hotel accommodation and transportation.

Currency Used On Site
The cost of the Arrangements on the Site are quoted in U.S. Dollars.

Our "No Fees" Policy
At the time of writing these Terms & Conditions there will be no booking fees or Credit Card and Debit Card fees charged to you.

How to Make a Reservation
Reservations can be made by you online on the Site in real time and if the specific Arrangements are available you can then add to the Shopping Cart. You can then open the Shopping Cart to see all the Arrangements you have made. You can then ‘Select’ or ‘Delete’ any item. Should you then wish to proceed with the Arrangements you will be asked to ‘Proceed to Checkout’ where you will be required to enter all the requested details. Once this process is completed a ‘Confirmation Invoice’ will be emailed to you. A ‘Voucher’ will also be emailed to you that you will need to present to the hotel when you reach Cuba. A voucher is not necessary for transportation.

Important: On the ‘Checkout’ page you will be asked to tick the box that says you have read and accept these Terms & Conditions, and the Terms & Conditions of Credit Card and Debit Card payments as shown in Annex 1 below.

If the particular Arrangements are not available you will be advised online as to how to proceed.

Where any of the Arrangements show "On Request" you will be advised online as to how to proceed.

Conditions specific to hotel reservation
Below you will find conditions specific to hotel reservations handled by Cuba Travel.

Credit Card and Debit Card Payments
Hotel reservations require payment in advance. Your Credit Card and Debit Card will be debited within 24 hours after making your reservation. Accepted Credit Cards and Debit Cards - VISA, MASTERCARD and AMERICAN EXPRESS. Your payment will be to Cuba Travel., and your Credit Card or Debit Card statement will state the name of the payer either as Caixa or Sabadell.

The Charges
The total charge includes all room charges, any meals where specified and taxes. We do not charge booking fees or Credit Card and Debit Card processing fees. Any incidental charges such as parking, phone calls, internet service, room service, room upgrades, late checkouts, food and beverages, medical fees or gratuities will be handled directly between you and the hotel. Your reservation is guaranteed for late arrival.

Cancellation and Alteration Policy
Once you have paid for your reservation, the following cancellation and alteration policy applies.

  • 1) If you cancel or alter the reservation 48 hours or more before your intended arrival date, we will refund you the total amount that you paid minus an administration fee equivalent to 3% of paid amount, with a minimum of US$ 20.
  • 2) If you cancel or alter the reservation less than 48 hours of your expected check-in date, we will refund you the total amount paid minus the amount of the first night of your intended stay.
  • 3) If you do not arrive at the hotel on the date of your expected check-in, we will refund you the total amount paid for the reservation minus the amount of the first night of your intended stay for no-show charges.

Refunds must be requested in writing within 60 days of the date of your intended stay at the hotel. Once this period has passed, no refunds will be made.

We will not make refunds to your Credit Card or Debit Card, other than the Credit Card and Debit Card that was used for your booking. We may process refunds via wire transfer, in which case we will deduct any bank charges from the refundable amount. We aim to process refunds within 3 working days after receiving your refund request and required information.

Whilst every effort has been made to ensure accuracy and availability, some errors might still occur. Once aware of such incidents we will make all reasonable effort to advise you within 48 business hours of the booking being made. We reserve the right to cancel the reservation and refund all monies paid, but this of course will be without any liability to you.

Accommodation
Hotels will provide accommodation to the person under whose name the reservation was made, referred to as the lead person, and to the accompanying persons as per the exact amount of adults and children booked into each room. The lead person must be present at the time of check-in, and all guests must present a valid passport.

Accommodation is usually available from 16.00 hrs on the day of arrival and must be vacated by 12.00 hrs on the day of departure. Bed type and smoking preferences cannot always be guaranteed.

The number of guests in each room is limited to the number of beds provided by the hotel. If the number of persons arriving at the hotel is different to the one selected during the reservation process, or children are not of the age required to classify as such in terms of charges/discounts (see 'Children'), additional charges will apply, payable directly to the hotel by you subject to the acceptance of such by the hotel.

In the event of the hotel overselling its accommodation, Cuba Travel will endeavour to negotiate with the hotel that the your booking be honoured; otherwise the hotel will be expected to relocate you to a hotel of equal standard or superior standard.

If any foreseen construction work becomes necessary at the hotel, or in the vicinity, preventing access to the hotel, following being advised by the hotel, Cuba Travel will advise you, quantifying the disruption to you and the hotel will be responsible for any additional costs incurred to ensure that your experience is not affected (including relocating to a hotel of equal standard or superior standard).

Child Policy
Infants up to 1 year 11 months and 29 days: free of charge. Cots must be requested directly at the hotels, with extra cost if applicable. At some hotels no cots are available, and infants must sleep in same bed as parent(s). Children rates will be confirmed during the reservation process. Children rates apply for ages 2 - 11 years (normally 50%), and only when sharing room with two adults. Children 2-11 years sharing room with 1 adult must be booked as adults unless otherwise specified. Some rooms do not have space for an additional bed for children, and therefore maximum capacity is for two adults plus one child only if that child shares the same bed, if the adults agree. Children 12 years and older must be booked as adults, however some hotels such as in beach resorts offer discounts for children 12 to 16 years. Children are not allowed in 'adults-only' resorts, where minimum age is normally 18 years. Minor’s dates of birth should be advised to Cuba Travel.

Parents or guardians are obliged to have in their possession the minor’s documents in order and it is their responsibility to inform themselves of the requirements with the respective authorities. Cuba Travel cannot accept the inclusion of minors to travel by themselves. Cuba Travel cannot be held responsible in case, even though it is forbidden, that a minor is included in the Arrangements without the Cuba Travel’s knowledge.

Food and Beverages
Where food and beverages are included in the Arrangements those food and beverages may be subject to alteration due to seasonal variations and availability of products and Cuba Travel or third party suppliers cannot be held responsible for such alterations. You must advise Cuba Travel of any special diets no later than 7 (seven) working days prior to your arrival in Cuba. Cuba Travel will endeavour to arrange such special diets with the third party suppliers but cannot be held responsible where such special diets are not available.

Identification, management and care of luggage and valuables
You should ensure that all luggage(s) is properly labeled for easy identification to include your name, the country and hotel name prior to arriving in Cuba. The safekeeping of luggage will be your responsibility and for you to make any necessary claims for lost, delayed or damaged luggage and personal items directly with third parties such as air or sea carriers, hotels or land transportation. Normally no charge will be made for the storage of property. Should the third party charge for storage it will be the responsibility of you to pay such charges. It is agreed that Cuba Travel or the third party shall not be liable for loss or damage to stored property, caused by negligence of the third party or its employees or by water damage, fire, theft or any other cause. Valuables have to be placed in the hotel in-room safe or in the safe of the hotel reception or other means provided by the hotel.

Special Needs or Dietary Requirements
Within the reservation process on the Checkout page you will find a Comments Box where you can make any notes regarding special needs or dietary requirements. There are limited mobility rooms at hotels and it is necessary for you to advise Cuba Travel of such requirements at the time of making your reservation. Likewise, you need to advise of dietary requirements. Cuba Travel will use its best endeavours to accommodate your requests but cannot always guarantee that such requests can be fulfilled by the hotel.

Conditions specific to transportation reservations
Below you will find conditions specific to transportation reservations handled by Cuba Travel.

Type of Transportation
Transportation also referred to as Transfers is provided by third party Suppliers and the vehicles may be saloon taxis, micro-bus taxis or coaches. Transportation cannot be provided unless you have also reserved hotel accommodation (see Logistics and General Conditions below).

Credit Card and Debit Card Payments
Transportation reservations require payment in advance. Your Credit Card or Debit Card will be debited within 24 hours after making your reservation. Accepted Credit Cards and Debit Cards are VISA, MASTERCARD and AMERICAN EXPRESS. Your payment will be to Cuba Travel, and your Credit Card or Debit Card statement will state the name of the payer either as Caixa or Sabadell.

The Charges
The total charge includes transportation between the points and by the vehicles that you have reserved. We do not charge booking fees or Credit Card or Debit Card processing fees. Fuel for vehicles are included in the charge, and drivers of vehicles are provided with meals and accommodation where applicable at no cost to you. Any gratuities are at your discretion.

Logistics and General Conditions
Transportation is limited to pick-up and drop off points using the most direct route as deemed by the driver. No alteration of the pick-up or drop-off points or designated route is allowed. The vehicle will be at your disposal at the time requested. The driver will wait no longer than 1/2 hr after the designated pick-up time has lapsed.

Cuba Travel cannot be held responsible for any delays of any transportation within Cuba which derives in the non-presentation of you at the designated arrival or departure time or day. If alternative transportation has to be arranged as a result of the aforementioned case you will be responsible for paying any extra costs involved for alterations to the Arrangements and any cancellation and alteration penalties.

The responsibility of transportation in Cuba enrolled in the Arrangements proposed by Cuba Travel as well as that of their third party Suppliers, their representatives and their employees, is limited exclusively to: compensations, complaints or reclamations of every nature in accordance with what is stated in their conditions of transport.

In the case whereby you choose to make your own private transportation arrangements in Cuba Cuba Travel assumes no responsibility of any kind for those arrangements.

Where the third party supplier provides transportation services, the third party supplier will ensure that it conforms to the minimum requirements of the country’s regulations, including safety regulations.

It could be that drivers of transportation need to make stops in route for sustenance, ablutions and toileting. It is also expected that the driver also allows the same opportunity for you. In addition, and for reasons of safety, the driver may need to make stops in route for short rest periods. Also, local safety regulations dictate that drivers should not drive continuously for more than 8 hours.

As Cuba is still a developing country you may find that some vehicles are not always fully equipped with seat belts usually in the back seats. Also, child seats are not easily available and it is recommended that you bring your own child seat.

Cancellation and Alteration Policy
Once you have paid for your reservation, the following cancellation and alteration policy applies.

  • 1. If you cancel or alter the reservation 48 hours or more before your intended arrival date, we will refund you the total amount that you paid minus an administration fee equivalent to 3% of paid amount, with a minimum of US$ 20.
  • 2. If you cancel or alter the reservation less than 48 hours of your expected arrival date, we will refund you the total amount paid minus the amount of the first day transportation charge of your intended stay.

Refunds must be requested in writing within 60 days of the date of your intended stay. Once this period has passed, no refunds will be made.

We will not make refunds to Credit Cards or Debit Cards, other than the Credit Card or Debit Card that was used for your booking. We may process refunds via wire transfer, in which case we will deduct any bank charges from the refundable amount. We aim to process refund within 3 working days after receiving your refund request and required information.

Mobility
You need to advise Cuba Travel either at the time of making your reservation (using the Comments Box), or no later than 72 hrs prior to your arrival in Cuba if you require a wheelchair at the airport. If you bring your own wheelchair it should be collapsible to enable it to be carried in vehicles used for transportation. You will need to advise Cuba Travel that you will be traveling with your own wheelchair either at the time of making your reservation or no later than 72 hrs prior to your arrival.

Animals
For reasons of hygiene and security, animals (pets) are not allowed to be included in the Arrangements unless previously notified, agreed by all parties concerned and complied with Cuban laws and regulations.

Insurance
Cuba Travel strongly advises you to take out travel and medical insurance to cover the cost of cancellation and other risks including personal accident, personal public liability. Medical insurance is compulsory to enter Cuba and you are responsible to be aware of any entry regulations.

Visas
Most tourists require a visa known as a Tourist Visa Card to enter Cuba. You need to check with the Consulate, the airline or your travel agent in your country of origin if you require such visa. If you are planning to do business, come as a journalist or do other work you will need a special visa obtainable from the Consulate. There are special requirements and regulations for Cuban Americans and U.S. Citizens to enter Cuba, details of such can be obtained from OFAC in the U.S., or your travel agent. Air and marine carriers will require that you have a valid visa before they allow you aboard.

Untoward Occurrences
The performance of the Arrangements are subject to the following occurrences as specified below which may make it inadvisable, illegal, or impossible to conduct all or part of the Arrangements. It is provided that all or part of the Arrangements may be terminated or altered for any one of such occurrences. In no event Cuba Travel or its affiliates be liable for consequential damages of any nature or for any reason whatsoever.

  • 1. Case of force majeure: natural or nuclear disaster, industrial disputes, adverse weather conditions, flood, fire, terrorist activity, civil strife, war or threat of war, riot, seismic activity, epidemics, governmental orders and the like.
  • 2. Delay of land, sea or air carriers.
  • 3. Alteration of times at airports, train stations, bus stations or seaports.
  • 4. Failure of you to arrive in Cuba as specified in the Arrangements.
  • Cuba Travel, where possible, will endeavour to notify you of any National festivities, civil or religious events or hazards that might affect the Arrangements. If your Arrangements are affected you might have to endure certain exceptions which may alter the Arrangements. Cuba Travel will inform you, where possible, as soon as these events or hazards are known and will make every endeavour to make alterations to the Arrangements accordingly. Cuba Travel will not be called upon or held liable in anyway in these cases.

    If Cuba Travel is obliged by reason of force majeure or for any other reason outside the Cuba Travel’s reasonable control to alter any component of a your Arrangements Cuba Travel shall inform you of the alteration and explain the reason for it, where possible, at the earliest possible opportunity.

    Cuba Travel reserves itself the right to cancel any Arrangements, revise or alter its contents and services in the event of untoward occurrences.

    Changes to your Arrangements
    Where Cuba Travel is obliged to alter Arrangements outside the Cuba Travel’s reasonable control Cuba Travel will use its best endeavours to ensure that the alteration causes the least possible disruption to the enjoyment of your Arrangements. To this end, Cuba Travel will consider and implement alternative and less disruptive alterations and advise you accordingly.

    Cuba Travel reserves the right to take necessary measures for the safety and smooth operations of the Arrangements where certain services are deemed impossible, or when there is valid reason to believe that the Arrangements cannot continue. In such cases, Cuba Travel will explain in a timely manner its inability to function under the circumstances. However, said explanation may be made after revisions are made when conditions demand.

    It also remains your responsibility to inform Cuba Travel of any revisions, alterations or cancellations of your Arrangements regardless of its causes giving enough notice to enable such changes to be made.

    Passports
    Your passport must be valid for at least 6 months at the time of entering Cuba. The details contained in your passport must be the same as on your visa.

    Liability, Accountability and Responsibility
    Cuba Travel acts as an intermediary between you and the third party Suppliers for the purposes of negotiating, contracting and the acquisition of services with third party Suppliers. Cuba Travel does not own, operate or provide in anyway any land, air or marine transportation, any property or vessel, restaurants and the like, or any products and services related to the aforementioned. Cuba Travel’s liability is limited only to claims of the administration of bookings covering the receipt and processing of bookings from you and the assignment of bookings to third party Suppliers.

    Cuba Travel shall have public liability insurance cover suitable to the nature of their business and/or services and will indemnify you in accordance with the insurance conditions.

    After the start of the Arrangements, if you should find that any of the Arrangements provided is different from that specified; you should report the discrepancy to Cuba Travel immediately.

    All or part of the Arrangements cannot be reimbursed if you do not show up on time in the place required at the set time for whatever reason. Such no show maybe subject to the Cancellation and Alteration Conditions.

    If you do not produce the necessary documents (passport, visa, medical insurance, vaccination certificates and the like) you may not be permitted to enter Cuba and if you have to leave Cuba any costs involved will be the responsibility for you to pay and no reimbursement will be allowed by Cuba Travel.

    No reimbursement will be granted in case you decide to alter the nature of the Arrangements in Cuba. Such alteration maybe subject to the Cancellation and Alteration Conditions.

    Cuba Travel may refuse the participation in any or all of the Arrangements if it determines that you act in a manner that inconveniences or interferes with the activities of others or the Cuba Travel’s staff or the third party Supplier’s staff, or the smooth operation of the Arrangements.

    You must abide by the laws and regulations of Cuba. Any acts by you which contravene these laws and regulations will be our liability and Cuba Travel will not be held accountable in any way for those acts. Cuba Travel will endeavour to provide necessary assistance for you from the authorities and your national embassy in these cases. Any cost involved in such assistance by Cuba Travel, any penalties imposed by the authorities or charges made by your national embassy will be the responsibility of you to pay, discharge or otherwise deal with.

    You shall indemnify Cuba Travel for losses sustained owing to your willful negligence, illegal acts, conduct against public order and the like , or breach of the Terms and Conditions.

    You are required to make every effort to utilize information acquired from Cuba Travel and any other entity and to understand the details of your rights and responsibilities as well as the details of the Arrangements and the Terms and Conditions.

    Health control standards and medical care
    Cuba Travel is not to be held responsible in case you are not capable of meeting the health control standards established by the Cuban authorities. It is your obligation to inform yourself of these formalities. In the case of you requiring special attention from Cuba Travel during the Arrangements for reason of ill-health or disability, you must advise Cuba Travel of this when applying to join the Arrangements. Cuba Travel shall comply with such requests to the extent deemed feasible and reasonable. In such cases, Cuba Travel may require you to present a medical certificate or other supporting documentation. Cuba Travel may refuse your booking request if conditions in Cuba and the facilities are such that safe, smooth operation cannot be guaranteed, or require you to be accompanied by an escort.

    If it is determined that you need medical diagnosis, care or treatment by a medical professional owing to illness, functional disease or other reasons during the Arrangements, Cuba Travel shall take measures necessary to assist you and at the same time maintain the smooth operation of the Arrangements. All costs resulting from such measures shall be borne by you.

    Complaints
    Should you have any complaint about the Arrangements or express any dissatisfaction whatsoever, you should contact us immediately followed by sending us your complaint in writing with supporting evidence to enable us to fully investigate complaints and respond accordingly. Cuba Travel will take all possible steps to resolve complaints amicably after Cuba Travel has before it all the necessary supporting information and documentation.

    In the event that Cuba Travel offers compensation as a result of your complaint, such compensation will be accepted in full and final settlement of the your claim. Any complaints and/or claims must be made within 60 days after your intended stay in Cuba.

    Reimbursements
    To guarantee that any reimbursements, such as refunds or compensation, be regarded as admissible it must be transmitted to Cuba Travel by you in writing and duly signed by you and sent either by hand delivery, by mail (postal service) or courier service at your cost and must be accompanied by all the elements justifying such a demand within a period no longer than 60 days after your departure from Cuba. Some postal services can take a long time to reach Cuba (2 months is normal), and it is your responsibility to check if the document(s) will arrive in the specified time as aforementioned. If for any given reason you cancel or alter any part of the Arrangements on the spot in Cuba no reimbursement will be admitted.

    24hr duty phone service
    Cuba Travel will provide you with a duty telephone number that you may contact any time 24 hours each day if you experience any untoward occurrences or emergencies in respect of the Arrangements.

    Group bookings
    Different conditions apply for reservations made for groups of more than 15 persons. You will need to contact us for further details before making reservations on this Site.

    Economic conditions
    The costs indicated are established in relation to the existing economic conditions. Any alterations of the economic conditions particularly the cost of fuel, taxes and fees, exchange rates, and the like, relative to the services offered in respect of the Arrangements, may lead to an alteration of the costs.

    Intellectual property and copyright
    Any ideas, images, creativity, wording, theming or content on the Site or otherwise communicated to you remains the intellectual property and copyright of Cuba Travel and its affiliates.

    Contract Formation
    No contract will exist between you and Cuba Travel or its Suppliers for the sale of any Arrangements unless and until Cuba Travel accepts your reservation by email confirming your reservation and issuing you a unique confirmation code. Acceptance will be deemed complete and will be deemed to be effectively communicated to you for all purposes at the time that Cuba Travel sends the email to you whether or not you receive the email.

    Severability
    If any provision of this agreement is determined to be invalid or unenforceable pursuant to applicable law by any court of competent jurisdiction, the other provisions of this agreement will remain in full force and effect. Any provision of this agreement held to be invalid or unenforceable, including but not limited to the warranty disclaimers and liability limitations set forth above, will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

    Amendment to these terms and conditions
    Cuba Travel reserves the right to amend these Terms and Conditions at any time. This contract cannot otherwise be altered without prior consultation and agreement with Cuba Travel.

    Entire Agreement
    These Terms and Conditions contain the entire contract between you and Cuba Travel and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified unless expressly agreed by Cuba Travel in writing.

    Indemnification
    You agree to defend and indemnify Cuba Travel and its affliates and/or their respective Suppliers and any of their officers, directors, employees from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of your breach of this Contract or the documents referenced herein; your violation of any law or the rights of a third party; or your use of this Site.

    Liability disclaimer
    The Suppliers providing Arrangements through Cuba Travel are independent contractors and not Cuba Travel or employees of Cuba Travel. Cuba Travel is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting there from. Cuba Travel and Cuba Travel Suppliers have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

    Settlement of disputes
    Should any disputes or discords arise on account of improper implementation or non-implementation of these Terms and Conditions, the parties take whatever action is necessary to settle the matter by way of negotiations or arbitration. In the case the matter is not settled by way of negotiations or arbitration, it should be put forward to the court of jurisdiction of the British Virgin Islands.

    ANNEX 1 Credit card and debit card online payments

    This Annex forms part of the aforementioned Terms and Conditions of Cuba Travel and should be read and accepted by you as part of your Contract with Cuba Travel.


    Making Payments by Credit Cards and Debit Cards
    You can pay us using any of the three Credit Cards or Debit Cards. You will not be charged any processing fee for this service.

    Security of Payments
    With this system only the holder of the card can make online payments, it is impossible for any fraud and security is guaranteed in the transactions.

    The system requires a "secret code" that the issuing bank of the card provides you with. The code is optional and you do not need to enter the code if you do not have it available. If you do have the code then enter it when requested.

    How to Pay
    • 1. The number of your card will be requested, the date of expiration, your name as it appears on the card, your billing address and the codes [CVV2/CVC2/CID].
    • 2. The issuing bank of the card proceeds with its identification and may request the “secret code" from you (optional).
    • 3. It is verified if the authentication is correct, in which case you continue with the payment process, simple and similar to the one that is carried out with any card type.

    Your transactions are carried out using the secure services of the online payment system of ……………………………The payment you make will been shown on your bank statement as Caixa or Sabadell.

    What is the code CVV2/CVC2 on VISA and MasterCard?
